Created to promote the protection of personal data of every citizen in Brazil, LGPD amends some articles of the Internet Civil Framework and establishes new rules for companies and public agencies regarding the treatment of privacy and security of user and client information. The text came into force this Friday, September 18.
What changes?
From your behavior on the social networks, to your daily commute around the city, going through your reading tastes and not forgetting your traditional registration records such as name, address and phone number: Have you ever wondered what a company does or can do with your data on the internet?
LGPD was created precisely to regulate these data collection and processing practices, which are often done even without the knowledge of the holder. From now on, all users have the right to know how organizations collect, store and use their personal data.
The central point of the new law is that no institution may use the data of any citizen without their explicit consent. The text also provides guarantees for the user, who can request that his data be deleted, revoke a consent, transfer the data to another service provider, among other actions. And the treatment of the data must be done taking into account some issues, such as purpose and necessity, which must be previously agreed and informed to the citizen.
SanctionsThe LGPD articles on administrative sanctions for those who disrespect the rules for processing personal data are not yet valid. Pursuant to Law 14.010/20, the sanctions come into force on August 1, 2021. The punishments can reach up to 2% of the revenue up to the limit of 50 million reais.
